Hi There. Wow, a greeting in a Terms and Conditions form. Cool, right? Anyway, here are the basics of what this document contains. You should of course read the whole document, but we thought you'd appreciate a "Greatest Hits."

Definitions:

Swap (noun)-An event where a user completes community service in exchange for free items from local businesses. When a Swap time is referred to, the beginning of the community service event is being referenced.

Swap (verb)-The act of participating in SwapServe. Community service organizations swap, businesses swap, and individual users swap.

Swappers-The regular users of SwapServe who give their time in exchange for free goods and services. This term is used interchangeably with "volunteers" and "users." Businesses and Volunteer Organizations are not referred to as Swappers, although members of either may sign up as a regular user of SwapServe and thus be referred to as "Swappers."

Reward-An item or service that a business posts on SwapServe.com and distributes to users as a reward for completing community service through the website.

SwapServe.com ("SwapServe") provides website services to you subject to the following terms and conditions. If you visit or use any or the services of SwapServe, you accept these terms and conditions. Please read them carefully.

Electronic Communications

When you visit SwapServe.com or send us emails, you are communicating with us electronically. By agreeing to these terms, you agree to communicate with us electronically. We will communicate with you via email or by posting information on this site. You agree that all agreements, notices, and disclosures and any other communications that we send you electronically satisfy any requirements that such communications be made in writing.

All of the content on this website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of SwapServe and protected by United States and international copyright laws. The compilation of all content on this site is the exclusive property of SwapServe and protected by U.S. and international copyright laws. License and Site Access

SwapServe grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of SwapServe. This license does not include any resale or commercial use of this site or its contents; any derivative use of this site or its contents; or any use of data mining, robots, or similar data gathering and extraction tools. Your User Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. SwapServe requires that users be 18 years of age or older.

Volunteer Opportunity postings, Business postings, comments, communications, and other content

Volunteer Organizations may post information about Volunteer Opportunities. Businesses may post information about reward items they are providing. There are also some communication tools for individual users. All of the above may be done so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, promotions of specific religious views, solicitations for fundraisers of any kind, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. SwapServe reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

If you do post content or submit material, and unless we indicate otherwise, you grant SwapServe a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant SwapServe and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify SwapServe for all claims resulting from content you supply. SwapServe has the right but not the obligation to monitor and edit or remove any activity or content. SwapServe takes no responsibility and assumes no liability for any content posted by you or any third party.

Swap Information and Descriptions

SwapServe attempts to be as accurate as possible. However, SwapServe does not warrant that "Swap Details" or other content of this site is accurate, complete, reliable, current, or error-free. As a business/volunteer organization, you agree to allow SwapServe to pair your organization with others to form swaps as SwapServe sees fit. While SwapServe makes an effort to ensure that your organization is represented positively, SwapServe does not guarantee that organizations will be 100% satisfied with the particulars of individual swaps. If there is a problem, your sole remedy is to contact us at info@SwapServe.com.

Business Use

Businesses can use SwapServe to promote themselves and contribute to the community by offering free items to users in exchange for giving their time in service to the community. When a business posts an item, our system will automatically pair it up with a service activity in the community. While businesses cannot select which service project they are paired with, the initial sign up process provides some opportunities to filter out unwanted affiliations. For example, some of our service coordinators are local churches. If your business does not want to be affiliated with a particular faith, we respect that right and allow you to adjust your preferences accordingly. Swapping through one business location is free. If a business wishes to sign up and promote multiple locations, it will pay a monthly fee. There is no long-term commitment or contract for adding locations via our website. Charges are applied upon sign up and are set up to automatically recur unless services are cancelled. This may be cancelled at any time. Contracts negotiated with SwapServe outside of the self-service system offered on the website may involve longer term commitments.

One of the most important components of SwapServe is the organic feel created by our exchange process. Thus, a business must offer free services or items on the website with no additional obligations or "strings attached." Discounts, coupons, or other promotional strategies that do not line up with this philosophy will not be allowed and are subject to deletion without notice. SwapServe does not guarantee when, if, or how many of your posted items will be claimed by users. Our system will post available items in the order they are received. The exchange concept necessitates available items and service opportunities. Thus, your items will be visible as long as there are service opportunities that match your items based on the matching formula our system uses. The role of the business is quite simple. You only have to:

Community Service Organization Use

Community Service Organizations can use SwapServe to promote service projects and gather volunteers. When an organization posts a service project, it will be automatically paired up with a reward item offered by a local business. These items will be given to people who volunteer for your project and others. These pairings are made automatically. Your organization is not able to choose which reward items get paired up with your service activities. We encourage you to leverage SwapServe to serve as many people and communities as possible, but we have four main restrictions:

  1. Fundraisers-You may use SwapServe to gather volunteers for fundraising events. However, they may not be fundraisers for any political party or candidate. Also, you may not use SwapServe to solicit donations. You may only ask people to volunteer to help staff your fundraising event on SwapServe.
  2. No Agendas-Our company is respectful of the freedom of all people to believe, vote, and view the world as they choose. We ask that you do the same by not using these events to promote any particular type of political or social agenda, religious belief, particular world view, etc. Prohibited activities include political rallies, protests, public demonstrations, signature gathering, campaigning, soliciting, etc.
  3. Minimal or No Application Process-SwapServe is meant to be a mechanism where folks can sign up to help on the website and then show up and work. Often there is some much red tape to go through just to serve one's community. We want to limit this as much as possible. Thus, we ask you to only post service activities that your organization is comfortable with coordinating and supervising without a lengthy screening process. Some examples of prohibited activities include direct contact with minors (tutoring, daycare, etc.), hospital visits, work involving valuables or sensitive material /information, etc. SwapServe does not screen its users and assumes no responsibility for the performance, background, qualifications, etc. of its users.
  4. No Personal Projects- This business is about serving the community. You may not post an event that is not explicitly an act of community service. Examples of prohibited activities including cleaning your personal residence, helping people move, etc. Violators will be removed from the site.

Other than the above restrictions, please feel free to get as creative as you can with service activities. Some examples of acceptable activities include beach clean-ups, cleaning up parks, sorting clothing for clothing drives, serving food to the hungry, etc.

On the day of the event, you must provide a Swap Coordinator who will supervise your community service activity and check swappers in and out. This person must have the swap checklist in hand and give out swap codes to swappers once his/her service is complete.

Changing Events or Offered Items

Before a business offers an item or an organization posts an event, we ask that both parties take the time to review the information and be as sure as possible of the details. These details can be altered, but alterations impact the quality of the user's experience of the site, so we ask that all parties keep changes to a minimum. Excessive alterations may result in restrictions of use. Plus, changing details of items and events that are already being offered can significantly impact a user's view of your organization or business. Thus, it is good practice to stand by your commitments, ensure accurate information is posted, and keep changes to a minimum.

Any changes to items offered by businesses or activities posted by community service organizations MUST be made 24 hours before the event or earlier.

We Do Not Screen People

All users should know that SwapServe DOES NOT SCREEN ITS USERS. While we do our best to deliver quality and deny service to users who violate our terms, SwapServe does not warrant, guarantee, or otherwise assume responsibility for the activities, performance, background, or attributes of any business, volunteer organization, or user. You should think of us as a high-tech version of a bulletin board at a local library, community center, or coffee shop. Anyone can potentially become a member of SwapServe just like any other site. Plan your activities accordingly. You are solely responsible for anything resulting from your use of SwapServe.

General Release

By agreeing to these terms and conditions, you agree to forever release and hold SwapServe, it's staff, owners, and affiliates from liability for any personal injury, business loss, or property damage.

We reserve the right to alter these terms at any time. Violators are subject to removal and restriction from joining without notice.
